Land use plan

Towns and municipalities must draw up urban land-use plans, i.e. land-use plans and development plans, as soon as and insofar as this is necessary for urban development and organisation. From the decision to draw up an urban land-use plan to its legal validity, various procedural steps under planning law must be carried out in accordance with the Federal Building Code.

There are currently no current changes to the land utilisation plan.


Costs

The costs for amending the land use plan are generally borne by the city. If changes are to be made in favour of a developer, the developer also bears the costs.

Development plan

The development plan defines the use and type of development of land and buildings in parts of the urban area.

The development plan is developed from the land use plan. As a "binding land-use plan", it contains legally binding urban planning regulations, the use and type of development of land and buildings in clearly defined parts of the urban area.

The objectives of a development plan are orderly urban development, socially responsible land use and the protection of natural resources, which are derived from general and public interests and are oriented towards the common good.

The development plan is adopted as a statute and thus becomes legally binding.

Costs

Design statutes

Design statutes are instruments under building law with which cities and municipalities can issue so-called "local building regulations" for a clearly defined area. These local building regulations can be issued as

  • as independent design regulations on the basis of state law provisions or in the form of design
  • be laid down in the form of design specifications in a development plan.

 

In contrast to the standardised design elements of a design statute, the design guidelines of the town of Olsberg provide recommendations for building projects and for the erection of advertising structures.
